Terms & Conditions

Terms & Conditions

Last updated: 23rd September 2026

These Terms & Conditions apply to purchases made through evesimpson.co.uk (the “Website”), operated by Eve Elizabeth Simpson, trading as Eve Simpson, a sole trader based in the United Kingdom.

In these Terms & Conditions, “I”, “me” and “my” mean Eve Elizabeth Simpson trading as Eve Simpson.

Please read these Terms & Conditions carefully before placing an order. By placing an order through the Website, you agree to these Terms & Conditions.

1. About me

The Website and online shop are operated by:

Eve Elizabeth Simpson
Trading as: Eve Simpson
Email: info@evesimpson.co.uk

Business Address: Simon Drabble Promotions, 2nd Floor, Stanley House, London Road, Hook, RG27 9GA No 16205401 VAT No. 435 0870 03

I am a sole trader based in the United Kingdom.

You can contact me using the email address above in relation to orders, products, complaints or any other enquiries concerning the Website.

2. Products

I sell music and merchandise through this website. Products may include:

  • physical music releases, such as CDs, vinyl or other physical formats;

  • digital music downloads;

  • merchandise, clothing and other physical products; and

  • other products or digital content described on the Website from time to time.

I make reasonable efforts to ensure that product descriptions, photographs and other information on the Website are accurate.

Colours and appearance may vary slightly depending on your device or screen.

Where a product is made available in a particular size, colour, format or edition, this will be stated on the relevant product page.

3. Squarespace and the online shop

My online shop is hosted and operated using Squarespace.

Squarespace provides the website, online shop and checkout technology used to display products, accept orders and facilitate payments.

Your contract for the purchase of products is with Eve Elizabeth Simpson trading as Eve Simpson, and not with Squarespace.

Squarespace is not the seller of my products and is not responsible for fulfilling your order.

4. Prices

All prices are displayed in pounds sterling (£), unless otherwise stated.

The price payable is the price displayed on the Website when you place your order.

Any applicable delivery charges will be displayed before you complete your purchase.

If VAT is applicable, prices will be displayed in accordance with applicable UK tax requirements.

I reserve the right to correct obvious pricing errors before accepting an order.

5. Placing an order

You can place an order through the checkout on the Website.

Before completing your order, you will have the opportunity to review your products, quantities, delivery information and total price.

When you place an order, you are making an offer to purchase the products selected by you.

You will normally receive an order confirmation by email after placing your order. This confirms that I have received your order but does not necessarily mean that I have accepted it.

A contract between you and me will be formed when I accept your order, normally when I confirm that the products have been dispatched or, for digital content, when I make the digital content available to you.

If I am unable to fulfil an order, for example because a product has unexpectedly become unavailable, I will contact you and refund any payment already made for the affected product.

6. Payment

Payment is processed through the payment methods made available at checkout.

The payment methods available may vary depending on the products in your order, your location and the payment services enabled on the Website.

Payment processing may involve Squarespace and its relevant payment-processing partners.

I do not normally have access to your full payment card details.

Your purchase contract remains with me, Eve Simpson, and I remain responsible for fulfilling your order and dealing with applicable refunds, returns, cancellations and consumer rights.

7. Payment authorisation and failed payments

Your order may not be processed if payment is declined, reversed, cancelled or otherwise not successfully authorised.

If payment cannot be completed, I may be unable to fulfil the order until valid payment has been received.

I am not responsible for a payment being declined by your bank, card issuer or payment provider.

8. Payment disputes and charge backs

If you believe there is a problem with a payment or order, please contact me first at info@evesimpson.co.uk so that I can try to resolve the issue.

Nothing in these Terms & Conditions prevents you from exercising any rights you have under applicable consumer law or any rights provided by your card issuer or payment provider.

9. Physical products

Physical products may include CDs, vinyl records, clothing and other merchandise.

I will send physical products to the delivery address you provide at checkout.

Available delivery options, estimated delivery times and applicable delivery charges will be displayed during checkout or on the relevant product page.

I will make reasonable efforts to dispatch orders within any timeframe stated on the Website.

Unless a different delivery period has been agreed with you, applicable consumer law generally requires goods to be delivered without undue delay and, subject to applicable exceptions, within 30 days.

If you request a particular delivery method that I have offered, the applicable delivery charges will be shown before you complete your order.

Once an order has been delivered to you, you are responsible for taking reasonable care of the products.

If your order arrives damaged, incomplete or incorrect, please contact me as soon as reasonably possible at info@evesimpson.co.uk

Nothing in this section affects your statutory rights.

10. Digital music and downloads

Digital music and other downloadable products are supplied electronically.

After successful payment, Squarespace may automatically provide a download link or other instructions for accessing your purchase.

Download links may be subject to technical restrictions or expiry periods imposed by the Squarespace platform.

If you experience a problem accessing a digital product you have purchased, please contact me at info@evesimpson.co.uk and we will reasonably assist you.

Digital music purchased from the Website is for your personal use.

You must not redistribute, resell, commercially exploit or make purchased digital music available for download by others unless you have my prior written permission or this is expressly permitted by law.

11. Digital content and cancellation rights

Different cancellation rules apply to certain digital content supplied electronically rather than on a physical medium.

Where you request that a digital download is supplied before the end of the usual 14-day cancellation period, I will ask you to:

  • expressly agree to the digital content being supplied before the end of that period; and

  • acknowledge that, once supply begins, you may lose your statutory right to cancel.

Where applicable, this consent and acknowledgement will be obtained through the checkout process and confirmed to you.

Nothing in these Terms & Conditions affects your statutory rights where digital content is faulty, defective or not as described.

12. Your statutory rights

Nothing in these Terms & Conditions is intended to limit or exclude any rights you have under UK consumer law.

Physical goods must, where applicable, be of satisfactory quality, fit for purpose and as described.

Digital content must, where applicable, be of satisfactory quality, fit for purpose and as described.

If you believe that a product is faulty, damaged, defective or not as described, please contact me at info@evesimpson.co.uk and provide your order details and, where appropriate, photographs or other information showing the problem.

13. Cancelling an order and returns

If you are a consumer buying goods online, you will normally have a statutory 14-day right to cancel your order without giving a reason.

The cancellation period for physical goods normally begins when you receive the goods.

There are some exceptions to this right. For example, the cancellation right may not apply to certain personalised goods or sealed goods that are not suitable for return for health or hygiene reasons where the seal has been broken.

For digital content that is not supplied on a physical medium, you may lose your statutory cancellation right when you have expressly agreed to immediate supply and acknowledged the loss of that right.

If you wish to cancel an order, please contact me at:

info@evesimpson.co.uk

Please include your name, order number and a clear statement that you wish to cancel.

Where you have a statutory right to cancel, I will provide any refund required by law.

Unless the product is faulty, damaged or not as described, you may be responsible for the direct cost of returning goods where applicable, provided you were informed of this before purchasing.

Nothing in this section affects your statutory consumer rights.

14. Refunds

Where you are entitled to a refund, I will process it in accordance with applicable consumer law.

Unless otherwise required by law, refunds will normally be made using the original payment method.

If goods are returned because you have exercised a statutory cancellation right, I may withhold the refund until I have received the goods back or you have provided evidence that you have returned them, whichever happens first, where permitted by law.

15. Personalised products

If I offer personalised or made-to-order merchandise, the relevant product page will explain this before you purchase.

Unless applicable law provides otherwise, personalised or made-to-order products may not be eligible for cancellation simply because you have changed your mind.

This does not affect your rights where the product is faulty, defective or not as described.

16. Availability

Some products may be limited editions or available only while stocks last.

If a product becomes unavailable after you place an order, I will contact you and, where I cannot fulfil the order, refund the amount paid for the unavailable product.

17. Intellectual property

Unless otherwise stated, all music, sound recordings, artwork, photographs, videos, logos, graphics, written content and other material made available through the Website are owned by me or used by me with permission.

Purchasing a physical or digital product does not transfer ownership of my copyright or other intellectual property rights to you.

For digital music purchases, you receive a personal, non-exclusive, non-transferable licence to download and listen to the music for your own personal use, subject to these Terms & Conditions and applicable law.

You must not reproduce, redistribute, upload, sell, commercially exploit, publicly perform or otherwise make purchased digital music available to others without my prior written permission, except where permitted by law.

Nothing in these Terms & Conditions affects any rights that cannot lawfully be excluded or restricted.

18. Website use

You agree not to misuse the Website or attempt to interfere with its operation or security.

You must not use the Website to distribute malicious software, attempt unauthorised access, or engage in activity that could damage the Website or its users.

I reserve the right to suspend or restrict access to the Website where reasonably necessary to protect the Website, its users or my business.

19. Third-party services

The Website may contain links to or use services provided by third parties, including payment providers, delivery companies, music platforms, social media platforms and email marketing providers.

I am not responsible for the content, availability or privacy practices of third-party websites or services.

Your use of third-party services may be subject to their own terms and privacy policies.

20. Events outside my reasonable control

I will not be responsible for delays or failures caused by circumstances beyond my reasonable control, including natural disasters, significant interruptions to postal or delivery services, technical failures, industrial disputes or other events that I could not reasonably have prevented.

This does not affect your statutory consumer rights.

21. Complaints

If you have a problem with an order or product, please contact me first at:

info@evesimpson.co.uk

I will try to resolve complaints fairly and promptly.

22. Privacy and personal information

I collect and use personal information in connection with orders, payments, delivery and, where you have chosen to receive them, marketing communications.

For information about how I collect, use and protect personal information, please see my Privacy Policy.

23. Mailing list

If you choose to join my mailing list, I may use the email address you provide to send you updates about my music, releases, merchandise, shows, events, news and related products or activities.

Joining the mailing list is optional and is separate from accepting these Terms & Conditions.

You can unsubscribe from marketing emails at any time by using the unsubscribe link in the email or by contacting me at info@evesimpson.co.uk

24. Changes to these Terms

I may update these Terms & Conditions from time to time.

The Terms & Conditions that apply to your order will be the version in force when you place that order.

25. Governing law

These Terms & Conditions are governed by the law of England and Wales, unless you live in another part of the United Kingdom and mandatory consumer protection laws applicable to you provide otherwise.

Any dispute will be subject to the jurisdiction of the courts applicable under UK law.
